ഇക്കഴിഞ്ഞ ജൂലൈയിലാണ് വിജ്ഞാപനം ഇറക്കണമെന്നു സര്‍ക്കാരിനോട് ഹൈക്കോടതി ഉത്തരവ് ഇടുന്നത്. നജ്മല്‍ ബാബു മരണപ്പെടുന്നതാകട്ടെ ഒക്ടോബറിലും! നജ്മല്‍ ബാബു മരിക്കുന്നതിനും മൂന്നു മാസം മുമ്പേ ഫിറോസ് മയ്യിത്ത് അടക്കാനുള്ള പള്ളിപ്പറമ്പ് തേടിപ്പോയി എന്ന് പറഞ്ഞാല്‍ വിശ്വസിക്കാന്‍ വേറെ ഊളകളെ നോക്കണം.

The Kerala High Court has directed the State Government to frame rules under Section 4 of the Muslim Personal Law(Shariat) Application Act 1937. The direction was issued by a Division Bench of Justice C.T Ravikumar and Justice A.M Babu in a petition filed by Thadevoos @ Abu Thalib.
The Bench applied its attention to the wordings of Section 4, which stated: 'The State Government may make rules to carry into effect the purposes of this Act(Shariat Act)'. The Court said that ordinarily the expression 'may' denotes that discretionary nature of action, as opposed to the use of 'shall'. However, in situations where the statute has etnrusted the authortiy with power, action will be mandatory under law even if the provision uses 'may'....
